Judge okays televising Prop 8 trial (via YouTube); begins Mon, Jan 11

Wednesday, the judge overseeing the Prop 8 overturn trial, which begins Monday, January 11, signaled he would allow the filming and limited broadcast of the proceedings:
Chief Judge Vaughn Walker made it clear Wednesday that he will forge ahead with televising the federal challenge to Prop 8...But he also signaled he doesn't want to be the next Lance Ito.

The trial, which begins on Monday, will be filmed by court personnel, Walker ruled, but it will not be broadcast live. Instead, the recording will be posted on a YouTube page at some point after the close of the day's proceedings. Walker declined an offer from In Session (formerly Court TV) to broadcast live, with its own crew..."I think in view of the nature of this proceeding, it is important for this process to be completely under the court's control," he said.

Lawyers representing the Yes on 8 campaign objected to any broadcast beyond an overflow room in the San Francisco federal building, arguing that witnesses would be intimidated, or change their testimony. But Walker was skeptical, pointing out that depositions have been widely videotaped for years. [Law.com]
Many of us got an email blast in the last few days from the Courage Campaign asking us to tell the courts televise the upcoming trial to overturn Prop 8; I'm not sure how YouTube is television or if broadcast networks are allowed to stream the YouTube version, but at least it won't be closed proceedings:
U.S. District Court Judge Vaughn Walker -- who will be overseeing a federal court challenge to Prop 8 starting this Monday (January 11) -- is considering whether or not to open the court room to TV cameras.

The court just announced that it is seeking public comment on the proposal to televise the trial -- and that all comments must be submitted to the court by a Friday deadline.

The interest in this case is unprecedented. And not surprisingly, supporters of Prop 8 -- who eliminated the right of same-sex couples to marry -- do NOT want the trial to be televised.

Opponents of Prop 8 -- led by attorneys David Boies and Ted Olson -- are seeking to televise the case in the interests of full transparency. They want this historic trial to be watched by as many Americans as possible. And, of course, we agree.
A recent decision in the 9th Circuit of Federal Court recently opened up the possibility of cameras in non-criminal trials. The Prop 8 trial will be its first test-run if Judge Walker's decisions stays.

The Courage Campaign, in expectation of large resistance from the Yes on 8 side, is still asking for us to fill the petition in support of the broadcast if we have not already signed it. I have always been in favor of us telling our real stories in order to change hearts and minds. Perhaps this trial will include that in addition to all the regular court room drama.

What's your coming out story?



For the past couple of days, I have been sharing the coming out stories of some friends of the Fruit. Today, October 11 is National Coming Out Day: what's your story? Use the comments section.

Update, 1p: Maybe these questions would help tell your story or at least part of it:
What was your coming out experience like? Easy/hard/somewhere in between? How was coming out to yourself? Your family? Those close to you?

Was there anyone exceptionally easy to come out to? Exceptionally difficult?

When/how did you know you weren't straight? Do you name your orientation? (Gay/bi/queer/trans/questioning, etc.)

In your coming out process have there been any major turning-point moments or moments where something major made sense to you in a new way?

National Equality March this weekend in Washington, D.C.: Who's going?

Someone desperately needs to hear your story: National Coming Out Day is Oct 11



Even if you've never commented on here before, please take a moment to send me your story. Lesbian, gay, bi, trans or questioning, there's a reader of this blog who desperately needs to hear your story.

October 11 is National Coming Out day, and this year's theme is "Conversations From the Heart". It's my belief that "conversations from the heart" are really what change the world...and it's hard work! One person at a time, for sure.

Please, PLEASE! Send in your coming out stories to this blog (via email is fine). I want to share them on the blog throughout the beginning of October and especially for National Coming Out Day. If you read this blog, please take a moment to talk about how it was to come out or how it is to be out in this community. And, if you're not yet out, please write in about how the process of coming out to yourself was/is.

I grew up in Napa and (didn't know it yet but) was yearned for positive examples of what it might mean to be a part of Napa and to not be straight. My coming out process was only possible because of courageous people who shared their story with me as I was older.

And a note: I'm a big believer in keeping this blog and community a safe place. I won't out anyone without permission and I won't share your name or email unless you tell me to. But please share your story.

Are you out and/or proud in the Napa Valley?

In another--hopefully not futile--attempt to get a conversation going (I know you all prefer to be lurkers, and I've forgiven you up 'til now), I'd like to ask a question and see where it goes. Answer freely via the comments to any of the questions that might inspire you. Don't forget there's an option to answer anonymously:

Are you LGBT or questioning and out in Napa? With friends? Family? Work? Since "coming out" is an ongoing process (at least in my experience), how do you choose when or who you come out to? Does it make a difference to how you feel if you were born here or grew up here or came here later in life? For you, is being queer something to be proud of?

I mean, I've talked about my own faith journey a bit before, and some of my struggles (and written about gay friendly churches in Napa and nearby) and so I'd like to know about you. Napa Valley Pride: Help pick our theme, vote in our poll

As I mentioned last week, we launched planning for Napa Valley Pride 2009 (to be held on the weekend of Saturday, June 20). Our next planning meeting will be on Monday, April 13 from 7-9pm at the Stonehedge Winery Tasting Room at 1004 Clinton Street in Napa (many thanks to TJ for setting this up!).

One of my tasks was to brainstorm theme ideas, making sure it evoked the following: inclusive, celebratory, pride, happy, togetherness, cheerful, summer, family, unity as a community... We also agreed as a planning group that for the theme, our biggest impact in Napa would be to not have a politically charged theme (and that our biggest political statement would be our presence and that we are an integral part of the overall community). We made note that the international Pride theme this year is “Your Rights, Our Rights, Human Rights”, and San Francisco's is "In Order to Form a More Perfect Union..." (click here for past SF themes) So much for avoiding overt politics. All that in mind, I sat down bounced some ideas around. Here's my stream of thoughts...

By the time I got to the grape stuff, things were getting a little silly. However a few stood out, and I'd like some feedback before the next planning meeting on Monday. I'll take your input, play around with the ideas some more and bring a final 3 to our next planning meeting.

Keeping in mind we wanted something INCLUSIVE, CELEBRATORY and FUN, what do you think of these:

Happy gay (and L, B, T) Valentine's!



I am not a huge fan of going OUT on Valentine's, what with the higher prices of food and flowers and the tons of people and sometimes drama. My love and I usually take this time to have a romantic and more simpler stay-at-home date. I love cooking and he loves cooking with me and we just make a big, cuddly, night of it.

But this romantic season does beg the question:

Where are the best places to take a same-sex date in the Napa Valley (or nearby)?

And in addition to the best ambience and food (or whatever), where are we least likely to get stares about our queer-ness?

MLK: A day for community service?

Howdy, Other Fruiters!

Happy Martin Luther King, Jr. day! It's a beautiful, sunny day and I'm just about to head out on a nice Napa Valley bike ride. I was reading that today is also a day for community service and volunteering (Obama rolled up his sleeves and helped paint and make repairs at an emergency teen shelter). One good stereotype about us queers is our community involvement. BUT, I was taken by surprise by today's volunteer focus. I run a non-profit and didn't really know that's what was supposed to happen. (Maybe I didn't get the memo?)

Vote: Top stories of 2008

We're coming to the end of an eventful year, featuring the launch of The Valley's Other Fruit on April 6, 2008. At launch I stated that my goal with The Fruit was to create more visibility and more community for lesbian, gay, bi, trans and allies living in Napa and nearby, by featuring news, gossip, events and issues that are of interest to our community. With 60 ongoing subscribers and visitors totaling almost 100 people a day, I feel proud of how far we've come.

At the end of the year it's a blogger's obligation (and mainstream media do it too) to do some sort of story re-cap of the year. I thought I'd throw the voting out to you, the loyal readers of the blog to say which stories were the most impactful. I dug through the stories and found some themes of stories that picked up a lot of traffic or that I thought were especially important to our coverage in the last year. Remember when?

Day without a gay? How'd it go for you?

Reports from yesterday are saying that the 'Day without a gay' wasn't as fabulous as planners were hoping. I'm guessing it is because many didn't wholeheartedly embrace the idea (including yours truly).

How was your 'Day'? Did you call in gay to work? Did any coworkers? Did you participate in any of the activities (volunteering, withdrawing money from your bank account, only shopping at queer owned/queer friendly establishments)?
